Terry earned his reputation as a “bulldog lawyer” by being aggressive, tenacious, and practical. He has successfully taken on major league adversaries including big oil, big pharma, and big government, in both litigation and transactions. Over the past 30 years, he has won more than $150 million for his clients.

He’s especially good at handling business partner disputes. He is the author of two books, Big Force Negotiation, and The Bulldog Guide to Business Partnerships.

Terry advises business clients in a variety of sectors, with concentrations in oilfield services, media, sports, health care, and real estate.

Terry has owned and operated successful radio properties, a professional hockey league, and a real estate investment company. This unique experience, in both law and business, gives him the specialized skills to solve disruptive business problems, from litigation to transactions to multi-party workouts.

He can also help with critical financing, transactions, and real estate matters, as well as more routine business documents like leases, sales agreements, and employment contracts.

Recent Trials

  • Jury verdict for entire claim of $365,000 plus punitive damages in favor of client logistics company defrauded by vendor.
  • Court trial award in clients favor defending client mental health provider in contract claim brought by former CFO.
  • $6.2 million settlement in favor of client defrauded in sale of business to private equity firm (first day of trial).
  • Confidential settlement in favor of client for in legal malpractice claim arising from business sale to private equity firm (fifth day of trial).
  • Won client the right to exercise Option to obtain $1.5 million in real estate equity in settlement (sixth day of trial).
  • Preserved client developers’ $8 million dollar property in Court trial defending against foreclosure claim based on fraudulent mortgage.
  • Three-week Court trial in Court of Federal Claims on behalf of family for breach of fiduciary duty in managing clients’ mineral rights. (Decision pending)
  • Settlement of entire contract claim of $600,000 plus $150,000 in attorney fees (first day of trial).

Representative Business Divorce Cases:

  • Successfully preserved and recovered funds for advertising agency partner, upon discovery of embezzlement by minority partner and major customer lawsuit.
  • Recovery of funds by minority owner in nursing home business, against majority owner, after majority partner made distributions excluding client.
  • Recovery of more than $1 million for two partners in independent living business who were terminated by majority partners in violation of company agreements.
  • Represented a victim of the Bernie Madoff scandal in a series of lawsuits resulting in agreements that ultimately returned all of the client’s assets.
  • Successful settlement of estate litigation preserving $30 million business for son of deceased against claim of woman who married deceased owner two weeks before his death.
  • Ensured the survival of a mental health care facility facing large operational loss by consulting on operational strategies, financing and defending multiple lawsuits.
  • Successfully defended $20 million de facto partnership claim, settling case for less than $200,000.
  • Helped screenwriter/director obtain bridge financing and navigate complex legal requirements, resulting in the production of an award-winning independent film.
  • Advised business partners in oil field machine rental company who had ownership interest seized by former partners, resulting in a settlement of more than $1.2 million.
  • Negotiated a $2 million settlement for two partners, who together owned 50% of a partnership involved in real estate development and had been frozen out by their partners.
  • Successfully negotiated Tech Company buyout of deceased partners’ estate for less than 30% of initial value claimed by estate.

  • Minnesota Supreme Court victory in ballot question of Minneapolis City Charter.
  • Minnesota Court of Appeals victory dismissing defamation lawsuit by political candidate against radio station.
  • Preserved $187 million for North Dakota taxpayers on a Constitutional claim in District Court on summary judgment, reversed on appeal (Cert denied by U.S. Supreme Court).
  • Workout of surgical center temporarily shut down by COVID.
  • Recovered more than $750,000 for a North Dakota mineral owner from an oil company for underpayment of royalties.
  • Successfully negotiated a contract dispute on behalf of a former executive denied payment by a large pharmaceutical company.
  • Led negotiations on behalf of a Major League Baseball team resulting in the most lucrative radio rights contract in Minnesota sports to that date.
  • Successfully defended a client against claims of a former partner seeking $12 million.
  • Assisted a trade group in forming a business alliance to lobby and defeat a proposed special tax to fund a professional sports stadium.
  • Worked through a series of lawsuits and agreements enabling the business to survive by obtaining an 80% discount on an operating loan.
  • Multiple successes both seeking and resisting injunctions and temporary restraining orders.
  • Reached confidential defense settlement on behalf of wrongfully-accused professional athlete of less than 5% of demand amount.
